The strategies that are chosen when bringing or defending a legal action are equally as important as the case itself. Victory does not always go to the party with the strongest case, but just as often to the party that has the best understanding of the legal process and the ability to use this understanding to its advantage to elucidate its arguments.
Kluge’s dispute resolution and litigation team has considerable experience in legal proceedings before the courts and other dispute bodies, and possesses the legal, technical and strategic skills required to solve all kinds of legal disputes at all levels of the courts in the best manner possible.
Kluge’s dispute resolution and litigation team undertake all kinds of commercial law matters. We assist in negotiations and various forms of mediation. If a case is not solved through negotiations or mediation, we litigate before the courts of justice and administrative appeal bodies and before Norwegian and international arbitration courts. The firm also has experience in conducting cases before the EFTA court.
Eight of Kluge’s lawyers are licensed to litigate before the Norwegian Supreme Court. Several of our lawyers are experienced arbitrators. Altogether, Kluge lawyers litigate over 100 legal cases each year.
Out-of-court mediation
A judicial resolution of a dispute is not always the best or most desirable solution, and Kluge assists in resolving disputes through out-of-court mediation in cases where a judicial solution is inappropriate for economic, commercial or other reasons. Several of Kluge’s lawyers are licensed mediators.
Judicial mediation
Even after court proceedings have been commenced, it is not unusual to try and seek an amicable solution through judicial mediation. Several of Kluge’s lawyers have a reputation as skilled judicial mediators. Two of Kluge’s lawyers are court-appointed external judicial mediators and experts in the field of mediation.
The courts
Kluge’s lawyers have considerable experience in litigating before the district courts, the courts of appeal and the Supreme Court. Approximately 30 lawyers regularly handle dispute resolution and litigation matters. Eight of our lawyers are licensed to practice before the Norwegian Supreme Court.
Arbitration
Disputes which are not settled out of court may be brought before the courts of justice. However, the parties may instead agree that the dispute shall be resolved through arbitration.
The lawyers in Kluge’s dispute resolution and litigation team have arbitration experience both as counsel and arbitrators. They assist in resolving domestic and international disputes before Norwegian arbitration tribunals and in resolving international disputes before ad hoc tribunals and tribunals established in accordance with the rules of international arbitration institutes (e.g. ICC).
Frame agreement with the Attorney General
Since 2003, Kluge has had an exclusive frame agreement with the Attorney General’s Office for civil litigation work on behalf of the Norwegian state. The cases are assigned to Kluge by the Attorney General. The frame agreement covers principally social security and immigration cases, but other legal areas are also covered. Kluge lawyers litigate approximately 50 cases each year on behalf of the state through the frame agreement.
