New EFTA Court judgement: contracting authority may be held liable even in a case of a simple breach of the public procurement law
On October 31 2017, the EFTA Court delivered a judgement (case E-16/16) regarding requirements for a claim for damages depending on infringements in a tender procedure. According to the Court's conclusion even a simple breach of public procurement law is, in itself, sufficient to trigger the liability of the contracting authority.
Gro Amdal has more than 23 years of experience within procurement law, and is Head of the Public Procurement law group at Kluge consisting of 25 lawyers.
Gro provides advice to clients in all stages of the procurement process, and has in-depth knowledge of the Norwegian rules and regulations regarding public procurement, as well as the EU Directives on public procurement.
She has been a member of the Norwegian Complaints Board for Public Procurement since 2011, as well as member of the Commission appointed by the Norwegian Government to examine the existing national rules on public procurement. Gro is co-author of the Commission’s Official Norwegian Report (NOU 2014:4) proposing new national rules on public procurement.
