New EFTA Court judgement: contracting authority may be held liable even in a case of a simple breach of the public procurement law

On October 31 2017, the EFTA Court delivered a judgement (case E-16/16) regarding requirements for a claim for damages depending on infringements in a tender procedure. According to the Court's conclusion even a simple breach of public procurement law is, in itself, sufficient to trigger the liability of the contracting authority.

Gro has more than 20 years of experience within public procurement law, in the utilities sectors as well as in the "classical" sectors. She has extensive experience with assisting clients in all stages of a procurement process, i.a. assessing the area of application of the procurement rules as well as its exceptions, advice regarding procurement strategy and alternative courses of action, drafting of ITT documents, assessment of bids, negotiations, award decision, and handling of complaints.

She is a member of the Norwegian Complaints Board for Public Procurement (2011-), and she was member of the Commission appointed by the Norwegian Government to propose new national rules on public procurement, see the Commission´s report NOU 2014:4.

Gro has extensive experience as a lecturer within procurement law, both in Norway and abroad.
